Agreement to Terms

By accessing or using FuelTracker's fuel management and telematics system ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

Description of Service

FuelTracker provides an intelligent fuel management and telematics system that includes:

• Real-time vehicle tracking and GPS location services
• Fuel level monitoring and consumption tracking
• Vehicle performance monitoring and diagnostics
• Driver behavior analysis and reporting
• Alert and notification systems
• Web and mobile application access
• Analytics, reports, and data insights

Account Registration and Security

Account Creation

To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials.

Account Responsibilities

• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized access or security breach
• You must not share your account credentials with others
• You must be at least 18 years of age to use the Service

Equipment and Installation

Tracking Devices

We provide GPS tracking devices and related equipment for installation in your vehicles or machinery. You agree that:

• Devices remain the property of FuelTracker until fully paid
• You will protect devices from damage, theft, or loss
• Installation must be performed by authorized technicians
• You will not tamper with, remove, or modify devices without authorization
• You are responsible for costs associated with device damage or loss

Subscription and Payment

Fees and Billing

Use of the Service requires payment of subscription fees as outlined in your service agreement:

• Subscription fees are billed monthly or annually as agreed
• All fees are non-refundable except as required by law
• You authorize us to charge your payment method on file
• Failure to pay may result in service suspension or termination
• We reserve the right to change pricing with 30 days notice

Taxes

You are responsible for all applicable taxes, duties, and government charges associated with your use of the Service.

Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service to violate any laws or regulations
• Track vehicles or individuals without proper authorization
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any systems
• Use automated systems to access the Service without permission
• Reverse engineer or attempt to extract source code
• Share, sell, or transfer your account to others

Data Accuracy and Limitations

While we strive to provide accurate data, you acknowledge that:

• GPS and sensor data may be affected by environmental conditions
• Service availability may be interrupted by maintenance, updates, or technical issues
• Data transmission may be delayed or incomplete
• You should not rely solely on the Service for critical safety or security decisions
• We do not guarantee prevention of fuel theft, accidents, or vehicle damage

Privacy and Data Usage

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to our collection, use, and sharing of your data as described in the Privacy Policy.

Intellectual Property

The Service and all content, features, and functionality are owned by FuelTracker and protected by copyright, trademark, and other intellectual property laws. You agree that:

• We retain all rights to our software, applications, and technology
• You receive a limited, non-exclusive license to use the Service
• You may not copy, modify, distribute, or create derivative works
• All trademarks, logos, and brand names belong to FuelTracker

Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUELTRACKER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify, defend, and hold harmless FuelTracker, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of your use of the Service, violation of these Terms, or violation of any rights of another party.

Term and Termination

Termination by You

You may terminate your account at any time by providing written notice. Termination does not relieve you of obligations to pay outstanding fees.

Termination by Us

We may suspend or terminate your account immediately if:

• You breach these Terms
• You fail to pay fees when due
• You engage in fraudulent or illegal activity
• Required by law or regulatory authority

Effect of Termination

Upon termination, your right to access the Service will immediately cease. We may delete your data after a reasonable period unless required to retain it by law.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.

Governing Law and Dispute Resolution

These Terms are governed by the laws of South Africa. Any disputes arising from these Terms or the Service shall be resolved through:

• Good faith negotiation between the parties
• Mediation if negotiation fails
• Arbitration or courts of South Africa if mediation is unsuccessful

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and any service agreements, constitute the entire agreement between you and FuelTracker regarding the Service and supersede all prior agreements and understandings.
